The case involving a former substitute teacher for the Chilton County school system facing charges related to sexual and other misconduct with underage students will head to a grand jury in February.
Rebecca Irene Hubbard, 35, appeared in court for a preliminary hearing Wednesday morning in front of Chilton County Circuit Judge Ben A. Fuller.
David Karn, the attorney representing Hubbard, waived the right to hold a hearing.
Fuller ordered the case to go before a grand jury, which will meet again in February 2015.
A bond reduction hearing was also held Wednesday morning where Hubbard’s legal representation requested Fuller reduce Hubbard’s bond, which is currently at $950,000.
Karn told Fuller that Hubbard has “strong ties to the community,” she had support from her family, and she came from a good home where her dad is a pastor in Chilton County.
As Karn explained to Fuller the support Hubbard had from family members, several of which were present in the courtroom, Hubbard sat next to her attorney wearing a red jail jumpsuit, with chains around her wrists and ankles.
Hubbard showed emotion by crying during the hearing as her legal representation explained the support she has from her family.
Karn also told Fuller that Hubbard’s life took a “serious” turn for the worse when she met her husband, and co-defendant in the case, David Hubbard.
“She is not a harm to the community,” Karn told Fuller. “She would abide house arrest, and would live with her parents if she were to be released from jail on bond,” Karn told Fuller.
Prosecutors from the 19th Judicial Circuit District Attorney’s Office told Fuller they were satisfied with Rebecca Hubbard’s current bond due to the nature of the charges involving sex crimes against children.
Prosecutors added that Hubbard could pose a threat to the community if she were released from jail on bond.
Hubbard and her husband, David Hubbard, 40, were arrested on 87 charges July 29, including facilitating the travel of a child for an unlawful sex act, school employee engaging in a sex act with a student under 19, second-degree rape, second-degree sodomy, enticing a child for immoral purposes, school employee having sexual conduct with a student under 19 and contributing to the delinquency of a minor.
During the time the crimes occurred, Rebecca Hubbard was a substitute teacher employed by the Chilton County Board of Education.
Fuller said he would issue an official order regarding Hubbard’s bond Wednesday afternoon.
