Commission Minutes

The Chilton County Commission met in a Regular Commission Meeting in the Chilton County Courthouse at 9 a.m., Monday, March 9. The following Commissioners were present: Bobby Agee, Allen Caton, Joe Headley, Greg Moore, M.L. Turnipseed, Tim Mims and Heedy Hayes.
WHEREAS, the Administrator presented the Commission with a list of purchases and claims and it appearing that all the claims are itemized with evidence of delivery of each item to the County as provided by law, and it appearing further that all claims are due, just, correct and unpaid and no part of same has been paid, Commissioner Turnipseed offered the following resolution which was seconded by Commissioner Headley:
BE IT RESOLVED that the Chairman is hereby authorized and directed to draw warrants in favor of the person, firm or corporation to whom it is due and from the funds designated.
Chairman Mims declared this resolution adopted by the following vote: Commissioners Agee, Moore, Caton, Headley, Turnipseed, Mims and Hayes voted “aye” with the following exceptions: Commissioner Turnipseed abstained from voting for the West Alabama Youth Services claim due to possible perception of conflict. Commissioner Headley abstained from voting for Headco claim due to possible perception of conflict.

Commissioner Caton offered the following resolution seconded by Commissioner Turnipseed.
BE IT RESOLVED that Minooka Park Manager Gerald Arrington proceed with the plans to hire an operator and machine to lay out approximately ten miles of new trails at Minooka Park and that eighty percent of the cost will be reimbursed by ADECA.
BE IT FURTHER RESOSLVED that the Commission receives in writing from ADECA that this project does not have to be bid out because it falls under the Public Works Bid Law.
Chairman Mims declared this resolution adopted by the following vote. Commissioners Turnipseed, Agee, Moore, Caton and Hayes voted “aye” and Commissioners Mims and Headley voted “nay.”

Commissioner Headley offered the following resolution seconded by Commissioner Caton and carried by a unanimous vote of this Commission.
BE IT RESOLVED to transfer from the Sheriff’s Office to the Road Department three light bars. Two of the lights are Edge 9000 and one is a Code 3. There are no serial numbers on these lights.
Commissioner Headley offered the following resolution seconded by Commissioner Caton and carried by a unanimous vote of this Commission.
BE IT RESOLVED that Chairman Mims sign a one year contract in the amount of $10,000 with Norment Security Group, Inc. for the maintenance and service of the jail doors. The contract will be effective April 1, 2009 thru March 31, 2010.
Commissioner Headley offered the following resolution seconded by Commissioner Moore.
BE IT RESOLVED upon recommendation of Sheriff Davis to transfer Travis Wimbush from part-time to full-time status replacing Veronica Harris.
Chairman Mims declared this resolution adopted by the following vote. Commissioners Turnipseed, Headley, Moore, Mims, Caton, and Hayes voted “aye” and Commissioner Agee abstained.
Commissioner Headley offered the following resolution seconded by Commissioner Turnipseed and carried by a unanimous vote of this Commission.
BE IT RESOLVED, there being no other nominations, to reappoint Mr. Keith Jackson, Mr. Glenn Pencoe and Mr. Billy Singleton to the Chilton County Airport Authority Board for six-year term.
Commissioner Headley offered the following resolution seconded by Commissioner Hayes and carried by a unanimous vote of this Commission.
BE IT RESOLVED for the Chairman to sign a one year contract with Southern Health Partners for health services provided at the jail. The annual premium remains the same as last year at $266,413.68 effective June 15, 2009 through June 14, 2010.
Commissioner Headley offered the following resolution seconded by Commissioner Caton.
BE IT RESOLVED that Mr. Bill Popwell hire a temporary clerk for the months of March and April 2009 in the Board of Registrars office with the understanding that the State of Alabama will reimburse the salary.
Chairman Mims declared this resolution defeated by the following vote. Commissioners Turnipseed, Agee, Caton and Hayes voted “nay” and Commissioners Headley, Moore and Mims voted “aye.”
Commissioner Headley offered the following resolution seconded by Commissioner Moore.
BE IT RESOLVED for the Chairman to sign the April 2009-April 2010 renewal contract with Travelers Insurance for County liability insurance coverage.
Chairman Mims declared this resolution adopted by the following vote. Commissioners Turnipseed, Agee, Headley, Moore, Mims and Hayes voted “aye” and Commissioner Caton voted “nay.”
Commissioner Caton offered the following resolution seconded by Commissioner Agee and carried by a unanimous vote of this Commission.
BE IT RESOLVED that this Commission opposes the legislation to transfer the financial responsibility of feeding prisoners from the Sheriff to the County Commissioners and;
BE IT FURTHER RESOLVED that this letter be sent to Sen. Erwin and to Rep. Martin.
Commissioner Headley offered the following resolution seconded by Commissioner Moore and carried by a unanimous vote of this Commission.
BE IT RESOLVED that the Administrator contact Ms. Tina Thompson, Chairperson of the Chilton County Humane Society, to request an independent audit. Once audit is complete Ms. Thompson should bring audit to the next regular Commission meeting.
Commissioner Hayes offered the following resolution seconded by Commissioner Turnipseed and carried by a unanimous vote of this Commission.
BE IT RESOLVED that the Chairman sign the co-operative agreement with the State EMA in order to receive state funding.
Commissioner Turnipseed offered the following resolution seconded by Commissioner Moore and carried by a unanimous vote of this Commission.
BE IT RESOLVED that Ms. Joy Littleton was on leave under the FMLA and that she has informed the Commission that she has returned to work effective March 1, 2009.
Commissioner Headley offered the following resolution seconded by Commissioner Hayes and carried by a unanimous vote of this Commission.
BE IT RESOLVED to go into executive session to discuss general reputation and character of an individual.
Commissioner Caton offered the following resolution seconded by Commissioner Headley and carried by a unanimous vote of this Commission.
BE IT RESOLVED that this Commission go back in regular session.
Commissioner Turnipseed offered the following resolution seconded by Commissioner Caton and carried by a unanimous vote of this Commission.
BE IT RESOLVED that the Administrator present to this Commission at each regular meeting a detailed financial statement.
