Jason Murphy was sentenced to 35 years in prison Monday for the 2003 shooting death of an Elmore County businessman.

Circuit Court Judge Sibley Reynolds handed down the sentence Monday afternoon in Wetumpka.

The trial was held in Chilton County, where last October a jury convicted Murphy of killing Ronnie Holman.

Murphy had been charged with capital murder but was convicted on the lesser charge of felony murder.

The Chilton County trial was the third one for Murphy. Two previous cases ended with hung juries.

Prosecutors had sought the maximum penalty of 99 years in prison.

Defense lawyers say they will appeal the case.

Prosecutors contend Murphy and his brother, Jared Murphy, shot Holman during a robbery attempt.

The victim was shot to death July 29, 2003, in the front yard of his home.

Jared Murphy is scheduled to stand trial in September.

He also faces capital murder charges.a
