A Clanton man was shot in the leg Tuesday night after coming home from work to find three burglars in his house.

The unidentified man was transported to the University of Alabama at Birmingham Hospital, where he was first in critical condition. As of Wednesday afternoon, his condition was downgraded to serious, said Clanton Police Chief Brian Stilwell.

“He should be OK. He is conscious and alert,” Stilwell said.

Stilwell classified the incident as a “burglary gone bad.”

The man came home from work and discovered his back door opened. When he went inside, three men were waiting for him.

The trio was described as black men wearing Halloween masks. One was armed with a shotgun, while another carried a handgun, Stilwell said.

After a brief struggle, one of the men shot the homeowner in the leg. They then left the house and fled, presumably on foot.

Tracking dogs were brought in to help find the suspects. The dogs found one man, Richard T. Agee, hiding in the woods near Peachtree Apartments. Agee remains a person of interest at this time and hasn’t been charged in the shooting, Stilwell said.

He is being held in the Chilton County Jail on unrelated misdemeanor warrants, including domestic violence and traffic violations, Stilwell said.
