Clanton man sentenced to 15 years on child pornography charges

Published Thursday, June 25, 2009

A Clanton man was sentenced Tuesday to 15 years in prison for receiving and possessing child pornography.

Jason Earl Roy, 29, was sentenced to 180 months for receiving child pornography and 120 months for possessing child pornography. The terms will be served concurrently.

Roy will be required to register as a sex offender and will be under lifetime-supervised release following his prison term.

U.S. District Judge L. Scott Coogler sentenced Roy, who pleaded guilty in February in U.S. District Court in Birmingham. Roy was indicted in December 2008.

According to the plea agreement, Roy received and possessed images of child pornography using the Internet. Law enforcement recovered the images during the execution of a search warrant.

His computer contained thousands of images of child pornography, depicting children as young as 18 months of age, as well as sadism, masochism, and bestiality, prosecutors said.

"This office will strenuously pursue the investigation and prosecution of crimes against children," Interim United States Attorney Joyce White Vance said. "Our goal is to uncloak the anonymity that the Internet provides to those who traffic in child pornography and bring them to justice. I'm proud of the work of the FBI and Assistant United States Attorney Daniel J. Fortune."

Acting Special Agent in Charge Charles E. Regan of the Federal Bureau of Investigation said the Internet has a dark side that is exploited by predators.

"I would remind every parent to continue to be vigilant in monitoring their children's online activity for their own protection," Regan said.

This is absolutely digusting. This man deserves absolutely no remorse. He needs to be strung up in the middle of town and stoned and castrated.

We all had this discussion back several months ago. His friends and family will post comments tomorrow proclaiming his innocence. They will claim he was protecting another family member and friends. Well, I aint the sharpest knife in the drawer, but 15 years of being sodomized and raped in prison for pleading guilty to a sex crime involving children and barnyard animals IS NOT my idea of being the FAMILY hero! The family and friends will post comments about how the FBI and US Attorney's office trampled his rights. But bottom line, he pled guilty, he WILL serve time, and he WILL be sodomized and raped in FEDERAL prison. The ends justifies the means. That's cruel comments, even from me. But that is REALITY. NO sugar coating. I would prefer to have him publicly hanged or casterated on PAY PER VIEW, and the proceeds given to a childrens victim fund. JUST MY OPINION! This is a legal disclaimer that has no binding relationship to the Clanton Advertiser or personal estate of any individual, including, but not limited to, kwsrgraves, his, her, and their, wills and or heirs.

THIS IS ALL THEY COULD GIVE A PIG LIKE THAT 15YRS. IS NOT LONG ENOUGH.MAYBE LIFE IN A HARD CORE PRISON NOT THE HOTEL FED.THAT IS TOO EASY.MAKES ME SICK TO THINK A CHILD WAS HURT.GOD BLESS OUR CHILDREN

littlelady, 15yrs. may be more than enough time, people in prison dont like it when you mess with little children. even some of them have standards or laws concerning certain crimes against humanity that's just unforgivable in their eyes. its bad enough when you have to watch your children against sex predators but when you have to hide your animals from them that's insane.

"depicting children as young as 18 months of age, as well as sadism, masochism, and bestiality, prosecutors said."

So there is no misunderstanding of how evil this man is...

sadism-The deriving of sexual gratification or the tendency to derive sexual gratification from inflicting pain or emotional abuse on others.

masochism-The deriving of pleasure, or the tendency to derive pleasure, from being humiliated or mistreated, either by another or by oneself

besteality-The deriving of sexual gratification by using animals

Anyone who wants to watch a baby being sexually abused, view someone being tortured or raped, or watch a poor animal being used for who knows what... is absolutely demon possessed! I just don't know how long God can bear to look down upon this earth and see what evil deeds some humans are inflicting upon others. It is beyond my comprehension how anyone can participate in such a defiant act against our Creator!

Do you get the "sex offender" label for being found guilty of this? Just curious if there will be notification given when he gets out and moves into a neighborhood.

I'd sure like to know if someone like this was living near my granddaughter.

Kathrine, the following was stated in the article , "Roy will be required to register as a sex offender and will be under lifetime-supervised release following his prison term." I too agree that this was not a just sentence. He was caught having this filth, we need to catch the people that are acting out this trash and then posting it on line for viewing by other perverted people.

Chilton 77 I agree that this man's deeds are disgusting, but the criminal justice system worked in this case. We don't tie people up and stone them in the town square anymore. If my relatives were harmed by this man I would deffinately feel like castrating him, but I would do my best to keep a rational thought process and let the system work.

I agree with urentitled2myopinion. It isn't enough to punish the people who find pleasure in this kind of filth. We need to find the POS's that published this stuff. If they are doing this on the internet what are they doing to the unprotected in real life.

The truly sad thing is that he probably had to pay for some of the websites he visited to get those pics, so that means they are making money off of it. Deranged is a good word to use here.

On this ocassion i have to agree with graves .When a rabid dog bites or attempts to bite someone the animal is put down.Once put down this animal will no longer be a threat to no one.Prison is too easy for this type of animal,in prison he will be placed in protective custody and therefore not be allowed to face the yard justice that he sorely deserves. When it comes to our children we should spare no expense to see to it that they never have the chance to ever see another child much less be around them with ankle monotoring hardware, but then thats just my view.

"Vengence is mine sayeth the Lord"
I bet all of you that want to give this man the death penalty are anti-choice on abortion, right? Well is life sacred, or not?
He should deffinately be puinished, but its not our place to decide whether he lives or not. God will deal with him when the time comes.

this man will get his when he gets to prison, regardless of what others may be there for, one thing that they hate is people of his kind. but I agree with ks they need to hang him and do the same to him as he done to the kids then let him die.
the kids are the ones that suffer for the rest of their lifes.
I know I was modested as a child and I am 39 years old and still suffer today.
The bad part about it the person that modested me never has done one single day in prison or paid for his crimes in any sort of way.
I know we are not to hate and we are to forgive, but it's really hard to do when something like this happens to you.

Posted by travlr423 (anonymous) on June 26, 2009 at 7:49 a.m. (Suggest removal)

blackwater, i think you are a little off course with this one. you are correct in saying the lord serves justice. but at the same time the lord gives us orders in how to behave as humans. we are not talking about a simple liar or cheating someone. we are talking about the safety of little children. I dont think god is entertained by that behavior no more than we are. and you think punishment by death is being a little hard wait until he faces the judgement on the other side. the lake of fire is eternal punishment. are you going to tell god he's being a little to hard.

Posted by blackwater (anonymous) on June 26, 2009 at 8:19 a.m. (Suggest removal)

Yes, trav, God gives us direction on how to behave such as, "judge that you be not judged." In God's eyes sin is sin. It doesn't matter if its lying cheating, or murder. I'm all for making our children safe, but hanging this man for his crimes is a vengeful act. He was tried, convicted, and sentenced. That should be the end of it.Two wrongs don't make a right. I'm not going to argue with God about anything on judgement day. I don't know where you got that idea from.

There is a website you can go to for registered sex offenders in alabama and do a search. It is VERY scary. I can't remember the site though. I think it's on the al.gov's site somewhere.

blackwater- I'd like to see you act rationally when it's your child or yourself that has gone through something like this. I'd like to think I could think rationally if something like this happened, but you never know what you'll do until you are put in that situiation.

Posted by blackwater (anonymous) on June 26, 2009 at 8:51 a.m. (Suggest removal)

chilton77 see my previous comment. I know it would be unbearable for something like that to happen to my family, but I would still strive to be rational about it.

Just because I would FEEL like killing a pervert for harming my family, doesn't mean that it is the right thing to do.

IT IS ON THE STATE TROOPERS WEBSITE...AND IF YOU CAN'T FIND IT, ALL YOU HAVE TO DO IS SEARCH ALABAMA SEX OFFENDERS. THERE ARE APPROXIMATELY 70 OR MORE LIVING IN CHILTON COUNTY. THEY DO NOT ALWAYS HAVE TO NOTIFY YOU IF THEY LIVE IN YOUR AREA. IT ALSO TELLS YOU WHAT THEY ARE CONVICTED OF, THEIR PICTURE, AND ADDRESS.

The scary thing is that research has shown that sexual offenders can't be rehabilitated. These type of impulses in such people drive them to commit the crimes over and over. I have watched several interviews and documentaries on the subject. The pervs themselves will tell you that it is something out of their control. In my opinion it's called SATAN!

Posted by PhilBurnette (anonymous) on June 26, 2009 at 9:24 a.m. (Suggest removal)

At the web address I posted, you do NOT have to enter a name. Just type in your city or county and see what is out there in our neighborhoods. In the Clanton list notice there is one who until recently ran a bar in town. According to the web site he was convicted of sexually abusing a 14 year old girl. Now why would such an individual be allowed to operate a business that serves alcohol? This is really disturbing.

blackwater, do you not think that the power of god enabled David to take out the giant. with a little stone and a slingshot. i got news for you. there has been more killing in the name of religion than any other cause. the bible says blessed is a man that can read and understand the scriptures rightly dividing the word. and yes murder is wrong, but i also believe their is a time when it becomes necessary. the bible says if a man knew what hour a thief was coming to his house he would not suffer the thief to break in and spoil his goods. Let a man mistreat my children or grandchildren and see how quick he gets his justice. ill worry about mine on judgment day.

God tells us not to judge a man's soul. God gives direction to follow. He intends for a man's actions to be judged. Taking scripture at face value for one incident, then applying it in depth for another situation is hypocrisy at it's worst.

blackwater, it would be great if the whole world could live love and agree as one. but it is the peoples choice not to. and for that reason even though sometimes our views seem rather dim and over killed sometimes it is necessary for things to take place in the hopes of making a safer world for our children and our heirs. if we had a magic wand that could change a person rather than the option of removing them from the human race that would be wonderful. but we dont and it is upon each individual to make the choice of being an asset or a stumbling block to the world around them. just as you and i make that choice each day.

Be thankful that Alabama is sending him away for 15 years. If this was Oklahoma, it's possible he might have been let off with a short sentence. Just recently a 64- year old ex-convict raped a 4-year old.....he was given a 1-year sentence.

Dottie, I know where you are coming from and I feel your pain, so do alot of others. Of my 6 closest friends in the whole world, there isn't a one of us that hasn't suffered the same. This is an even bigger issue than child porn on a computer and it will continue to be an issue until it is brought into the open and addressed by society.

Phil, as you know, the case you referred to was a case I investigated, took to grand jury, and got 8 plea agreements. The pleas were handled by the DA's office, and I did not agree with the final results. However, once the case is turned over to the DA's office, it's their ball to play with. The girl was actually 13 at the time of the offenses. She did look 20 years old. But the fact was she was 13. But 8 grown men over that summer had consensual sex with a 13 year old. None of it was forced or, even, coerced. As with my neighbor, back in the early 70s, he was a teenager, living out in the "country" and had sex with a girl just under the age of consent, (16). However, the law is the law, and for 40 years he has been stuck, (mentally) in 1970. He served his time and has NEVER been a threat to my wife or daughter. They have actually experienced more lewd comments in the isles of Wal-Mart. People do screw up, (pardon the pun), and make instantaneous decisions. The life they live afterwards says volumes. But, this guy was caught looking at pictures, (thousands), not physically molesting goats, chickens, pigs, kids or hamsters. I have, on occasion, watched people smoke pot, sniff coke, and smoke crank. Didn't make me an accomplice, or user. However, unlike this cat, I wasn't ACTIVELY seeking that behavior or trying to cover up and hide my position. This cat made overt moves to cover his tracks. Therefore, to this point, his punishment may be a little on the harsh side. 10 years seems more appropriate for VIEWING. But, I DO NOT disagree with the sentence.

Yes, trav, God gives us direction on how to behave such as, "judge that you be not judged." ...........

Blackwater, read a little further in that chapter and you will read, " By their fruit you will recognize them.........a bad tree cannot bear good fruit. " Furthermore, there are many biblical accounts of God using human beings to carry out his vengence against the unrighteous.

laura...the article indicates the sentences will run concurrently, meaning he will only serve the longer term of 180 months, or 15 years.

I can't believe I agree with kswgraves 100% for a second time :) He is correct in his obersavation that people read the Bible and make it mean whatever they want it to mean.
Blackwater is probably a sincere and wonderful person, but is way out of touch with reality. Blackwater makes a bet
that, and I quote " I bet all of you that want to give this man the death penalty, are anti-choice on abortion, right?" What in the heck does this bet have to do with anything about a pervert molesting a child? People who think like Jason Earl Ray and people who think like Blackwater ... frighten me!

Posted by blackwater (anonymous) on June 29, 2009 at 8:22 a.m. (Suggest removal)

Rickey. My comment was intended to make people think about what they were saying. Anti-choice people support their position by saying that life is sacred, but let somebody get sentenced for murder or something worse and they are the first to say 'give him the death penalty.' I know what I said doesn't have anything to do with molesting a child. If you even read the article before you commented you would see that this guy had possesion of pictures. He wasn't found guilty of molesting a child, but some people on here think we should hang him. For pictures! These people were probably in church yesterday singing about the forgiveness of Jesus. It sounds good for them, but they are quick to judge if a man should live or not after commiting a crime. It's hipocrisy.

Posted by blackwater (anonymous) on June 29, 2009 at 8:25 a.m. (Suggest removal)

getbizi. Please read the New Testament.

Posted by Rickey (anonymous) on July 10, 2009 at 4:35 p.m. (Suggest removal)

You CAN NOT "make people think about what they are saying." In fact, you can't MAKE people do anything. Perhaps this was just a poor choice of words on your part. For you to suggest that I hadn't even read the article before I commented, is just plain ludicrous. You have no idea what I have done nor what I haven't done. But just for the record, I did read the article before I commented. And to assume that "these people were probably in Church yesterday" is just plain ignornace. You have no idea where ANY of these people were yesterday. You don't know where they were day before yesterday, and in fact, you don't know where they are TODAY! The developing pattern here is that "You Don't Know" and I feel qualified to announce that you probably won't know where they will be TOMORROW either.
It is not so much your opinion that disturbs me. No and no again! What scares me is your entire line of thinking. Just a another person full of assumptions, with a computer and a comment. A wise man once said: "To know is genious - to merely think one knows ... is ignorance!

Posted by blackwater (anonymous) on July 20, 2009 at 3:23 p.m. (Suggest removal)

Rickey. I didn't intend for 'make people think about what they are saying' to come across as me being forceful. To suggest that people think about what they are saying is probably a better description of what my intent was. When I was suggesting that certain individuals were probably in church the previous day it was to illustrate the hipocrisy of some. I don't literally care if they were in church or not. I think its pretty ridiculous that you took the time to explain all of that. I claimed that it seemed like you hadn't read the article based on your previous comments. Thanks again CAPT OBVIOUS for pointing out that I don't really know if you read it or not. Don't let my 'line of thinking' scare you. You have to know more about me as a person than what you get from an internet comment before you can decipher my line of thinking.
