Clanton man pleads guilty to possessing child porn

BIRMINGHAM – Jason Earl Roy, 29, of Clanton pleaded guilty today in United States District Court in Birmingham for receipt and possession of child pornography.
Roy was indicted in December 2008.
According to the plea agreement, Jason Earl Roy received and possessed images of child pornography by using Peer-to-Peer software via the internet. During the search warrant, law enforcement located multiple items of computer media that contained images of child pornography.
A computer forensic analysis of the defendant’s computer media revealed thousands of images of child pornography. The images of child pornography depict children as young as approximately 18 months old involved in sadistic and masochistic conduct and bestiality.
“Roy admitted to using his parent’s computer and his own laptop, with P2P software, to share child pornography images. These photos were produced in other states, other countries, and travelled via the internet,” stated United States Attorney Alice H. Martin. “We aggressively pursue the ‘consumer’ of this filth as well as the producers.”
“A top priority of The Federal Bureau of Investigation is to seek out those who prey on innocent children,” said Carmen S. Adams, Special Agent in Charge, Federal Bureau of Investigation. “Any suspicious online activity where a parent suspects their child may have been in contact with a sexual predator should be reported immediately.”
For Receipt of Child Pornography, Roy faces up to 20 years in prison with a mandatory minimum of 5 years and a fine of up to $250,000. For Possession of Child Pornography, Roy faces up to 10 years in prison and a fine of up to $250,000.
This case was brought as part of the Department of Justice’s Project Safe Childhood initiative and continuing efforts to target individuals who possess and distribute child pornography.
In February 2006, former Attorney General Alberto R. Gonzales created Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the U.S. Attorneys’ Offices nationwide, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims.

Honestly i think these people should be put away for good. being a pedophile is more of a sickness and most of the go right back to it after being freed...
Better for himself and the public if he's institutionalized for life or something away from children for good.

I know this boy he is not quilty of this.You can downloadmusic from sites & get porn downloaded from someone else's
computer.Other people used his computer but he will serve the time for it.Don't believe everything you read.
He is a good person I would trust my child around him anytime.

Excuse me, but he was told if he said he done it, then he would be in no trouble. Trust me he didn't do it, anyways whoever wrote the story doesn't even have the right info, because this is completely wrong. He would never do anything to hurt a child,I should know he is my boyfriend and I love him & stand beside him. Anyways the prosecution admitted theirselves that it could have been downloaded accidentally, cause it happens all the time, but you still go to jail. So just think if it was your loved one that was pressured into saying they done something they didn't. Now people are going to look at him bad for nothing, because he is the sweetest & most honest person you will ever meet.

The thing of the picture being an 18 month old is new news to even him, so that is so wrong! And he didn't live at home wth mommy & daddy thank you! Just like I said if it was someon you loved and you knew they were wrongfully accused you would be singing a different tune!And also when you download things off of limewire, they even admitted theirself that you do not know what you got until it has downloaded. N-eways if he liked it why was it immediatly deleted off the computer as soon as it was shown as that? They failed to mention that part, huh? If he was a pervert it would have still been on the computer and guess what, it wasn't it had been deleted as soon as it was put on their.

MRSS, He pled quilty he wasn't given much choice.Don't judge me because I know the full story.And I would allow him around my children.Just because it's in the newspaper its not the gospel truth.kwsrgraves,you don't know everthing.He didn't have to explain to the judge when, where,and how because he didn't know when, where, and how! And the only reason he is in there right now, is because he is taking the blame, so someone else doesn't have to suffer! He was told if he would do that, then he would be home now, but hey what wonderful liars they are! Oh and another thing, I don't think any of y'all were sitting in court today because their was no age of a child released or how many images. That was never brought up and is not being held against him, because that was not used.Thank You! SO unless you were there and truely know the whole case, don't judge because it is a good possiblity that your son or daughter has done something wrong or has been accused of wrong doing when it was not their fault! Actually most of the porn was incrypted in other files that yes was music and you don't know they are there until it is to late. And you being a man, yes you have looked at porn maybe not off of limewire and maybe not kiddie, but hey it might be on you phone, pc, or whatever now and you don't know it! You people have no clue and don't care about the family that is hurting right now, becuase their son did nothing. But you will make sure that you make others lives hell, because you are heartless. Now yes if he had been into the kiddie porn, yes I fully agree, put him under the jail, but you don't know him or this case. SO back off!If he was guilty then yes, let him stay their, but he is not. Nobody can say anything about stealing music, but no unfortunalty no one knew that wrong files were in the music. Also, the judge has not said that he is guilty yet, he hasn't even heard his part of the story, so no judging yet. And something that I think is so sad is that a couple of months ago my friends ex-stepdad, who lives in chilton county, actually raped a 9yr old girl and was caught in the act, and guess what he is out right now walking the streets in chilton county.His story never made the news and we do not even know when that aweful person will or ever go to prison , and he needs to. But hey my boyfriend gets accused of something he didn't do, lets put him all over the paper. I think that is little messed up, that someone who was caught violating a child is free as we speak, and my poor boyfriend did nothing and would never do something like that, but lets keep him locked up and put the story everywhere! That is so wrong!

And something else none of you know, because of course this part was not told in the story,is that the plea agreement was wrote up because the prosecution did not have the evidence that they said they had against him, so to save their self they started making deals! Hmmm!

you are the sicko's for judging someone you don't even know. this happened while downloading something else. when he realized what it was he deleted it. he has never touched a child in that way,and he would never do it. i know because he is my son. i love him, believe in him and will always stand beside him no matter what. so you can say what you want. you don't know him or the real person he is. his family supports him 100 percent.

You would NOT plead guilty for this if you were innocent! If the prosecution was making plea deals because they didn't have sufficient evidence, then he should have let it go to court to get his side out. He was obviously afraid to do that because something else would come out. Cut your losses and move on. If you have kids with a sex offender, they could take them awasy.

I feel for the family but WHY would he say he's QUILTY if he wasn't? That will stay with him forever.I know his friends and family will stand by him no matter what...If he is quilty then he needs to be behind bars..No one knows what they will do if it was thier son until it happends to them...Everyone says they will do this and they will do that but like I said you dont know how you would feel unless it was your child.You cant blame the boys family for beliveing in thier son..And you cant blame his family for what he has done.

Guilty plea or not, as a system administrator (at least until I was laid off two weeks ago) I can assure you that the sort of pornographic images that are deposited on unsuspecting machines via Trojan horse malware do not alert the authorities nor are they used to prosecute computer owners. The actual content must be seized along with some kind of proof of download like search engine records. It often takes, as the article states, thousands of illegal images of subjects clearly underage to prompt an investigation and a warrant.
So don't feel sorry for this scumbag.

OMG graves--- I actually agree with you 100% on this one. As a mother of two, anyone caught with child porn needs to be castrated, because everyone is right it only leads to molestation. If you’re looking you’re curious and eventually will seek out a child to fill "your needs". I'm a yr shy of a BS in Criminal Justice, and no you don't plead guilty to something "you didn’t do" or to cover for someone else. If they have enough evidence on you to arrest you usually they have enough to prosecute and get a guilty judgment, no body plea's out unless you are scared more will come out in a trial and you could get more time. Doesn't matter who it is, I wouldn’t go to jail for anyone.
My kids download from lime wire all the time, and I have net nanny on all the computers so I know they aren't "accidentally" downloading porn, much less kiddie porn. My computer at work was having problems with pop ups yes the dirty ones, called the IT guy and I don't have that problem anymore, but still none of it was Kiddie Porn, you actually have to search for that and its not the pop ups, this stuff is a network of people who meet in chat rooms and share this stuff with each other, that is how they are being traced and tracked down, normally 1 person in those chat rooms is a "undercover" pervert.

I do not know him. I too have used Limewire and have never received anything pornographic. I dont understand, how he could have received THOUSANDS of images and still using these sights? And this is sone that no matter how juicy the bargaining was, I would have gone to my grave before pleading guility to this.

10665 music was downloaded from limewire a year ago.The porn got downloaded then & the fbi is notified from limewire.KWS if you worked for a DA you know how crooked they are.The porn was never watched it was deleted but you can get arrested for it.If he knew who downloaded it his life woulding be wasting away in jail.On limewire its not listed as kiddie porn.Keep going on limewire & sites like it .And you may end up with it to.

Computer sex crimes can't not be "fabricated" by anyone. There are to many ways now to track down IP addresses, and doesn't matter how many times you delete stuff, unless you really know what your doing with a computer information stays on the hard drive forever. And anything you do on the internet is PUBLIC not PRIVATE....
Also emails, no matter if you delete them are forever. Just ask everyone in public office who has been brought down by emails and things on thier computer that they thought they got rid of yrs ago.

This was not accidental downloading the only way to get things from your computer to a floppy or an external hard-drive it to insert the floppy, CD or the cord for the external hard-drive into your computer and download and copy them to the external device.
THAT PROVES RIGHT THERE HE KNEW WHAT HE WAS DOWNLOADING.

whether he is guilty or not, who really knows. i do know if a person is caught in the act he should receive his or her just reward without delay. and i do know for a fact that our legal system has a proven method of convincing someone who is not guilty into taking a guilty plea, whether its for the charged or a lessor offence. if he is guilty he should be executed to death. but if he is truly not guilty, i would not want to stand before Jesus Christ with his blood on my hands. and if even in a blog i accuse him without truly knowing his guilt i will answer and give account when i stand before god. so my response to this article is (may gods will be done) and may gods great mercy and his abiding love be with this young man and his family and friends. i will not cast stones at this family or their son, but i will pray for them because the bible says there is not one of us who is perfect and without sin. and Jesus came to pay the ransom for many sins.

IF he had an attorney and he was "told he wouldn't be in trouble", wouldn't his attorney have prevented the guilty pleading.
At this point, he's pleaded guilty. He'll now have to bear his scarlet letter because he'll be registered as a sex offender.
Every sex offender has a story and many of them are looked upon as completely innocent by loved ones. They might be harmless; but at one time the law says they weren't. The sex offender status is for life.

He may light up a room that he walks into, but he's not the brightest bulb in the package for taking a plea. The points you raise should have been and probably were addressed by his lawyer and yet, the verdict was still rendered as: "GUILTY".
Do you hear appeal in the air: "Incompetent representation" at trial. Guilty? - let's blame the lawyer- uneducated? Let's blame the schools, a criminal? let's blame bad parenting.
While he's in prison, he's free to light up any room he feels safe enough to enter.

Not one person out there wants to tell people they have raised a pedophile. My heart goes out to this family. Please look closely at your son. Love him enough to see through what he is telling you into the "real" truth. If he has downloaded these photos, he needs you now more than ever to support him. Help him to realize that this is a sickness and he needs to seek help while he is incarcerated. The sad truth is that people who commit these crimes serve the time and are released only to commit a more heinous crime. I hope that he has been caught before he moved from fantasies to actually hurting a child. If he is trying desperately to get you to believe he did not do this, look at it as a good thing, he realizes that it is wrong. Being in such a small town has put a larger spot light on this than if you were living in large city. Take this opportunity to see that there are some people who want to help you rather than judge you. I know this is hard for you and I will keep your family in my prayers. I have two small children and I am glad that something is being done about people who view these types of pornography. I am sure if this wasn't your son that you would feel the same way too.

I just want to say that I have downloaded music from limewire...which I PAY for...for over 5 years. I have never downloaded porn by accident, it usually says that its porn before you download it, all you have to do is check the name and whether or not its a mp3 file or if its a picture or a video. There is NO excuse for what he done and his family just needs to deal with this harsh reality. It is a bitter pill to swallow, to think someone that you love could do this, but they need to realize that he did do it, he pleaded guilty, and he is gonna serve his time for what he done.

Any 29 year old man that has child pornography on two computers, floppy disks, CD-roms, and external computer hard-drives (S: as in plural- more than one..) did NOT "accidently" have it. As a teen, I download music from Limewire all the time. When I type the song name in the search box to find what I want to download, I do see porn that you can download, but it does have a name to it and you can clearly see that it is porn. As long as I've had Limewire downloading music, I've never gotten anything but the song I wanted..
Also, there is no way I would plead guilty for such a huge crime such as this to -cover up- for someone else.. it's a dog eat dog world where you do as much as you can for yourself to make it.. much less giving myself the name of Sex Offender for the rest of my life to help someone else out..
I understand the family.. being with him with support 100%, but there is NO way that this could be ironic or such a coinsidence.
This man should definately be put away for as long as he lives for looking at a child. This is disgusting- I don't understand how people can be so perverted.. && I am judging him- by the fruit he bears.

I don't know this person and would not dare to stand in judgment. I also know people who were charged with sex crimes and plead guilty to a lesser offense because they were terrified of being placed in prison for 15 years instead of 3. Yeah 3. Which sounds like what this person may have done.
On the other hand as an adult survivor of child sexual abuse, I can tell you that abusers and porn freaks don't always fit the picture that people have in their mind. They can be charismatic, light up a room, charming, deacons, preachers, Sunday school teachers, attorneys, judges, police officers, mechanics, school teachers, principals, fireman, etc.. all who are looked upon as fine upstanding citizens. Do you really think that sick people like that are going to reflect their true nature to the public, including their family? I'm here to tell you, NO. In a lot of cases, not even their family are aware of what they're doing. WAKE UP PEOPLE AND SMELL THE COFFEE!!

It says that the FBI investigated this. Well I know they didn't say hey let's just make up stuff on this boy. They have way more important things to do!!! And if he didn't do it and saying that other people used his computer. I would be spitting those names out so fast it would make everybodys head spin. Let me just tell you people something! The fbi told me theirselves that they do watch limewire, so maybe you need to be watching out! And they even admitted that when you download porn that their are plenty of websites that have kiddie porn in them and they are actually labeled as legal sites. So the feds admitted that theirself. As for the story in this paper it is wrong. They were not even supposed to write this story up like this because none of these details were even mentioned in court yesterday, not even part of his case. SO whomever got the details wrote this illegally because their was an agreement that no details be released, because the feds said they were not bad enough. And yes sorry but the feds do lie to you, just to get whatever they want from you. SO like I have said he is not a bad person and I will gladly have kids with him one day. Oh and he hasn't even been to court for the judge to say that he believes he is actually guily. And for you people who say that his kids will be taken away, no they have already told him, that they believe he would never touch a child and he can have them and live with them. So if you wasn't there yesterday in court, then you do not know the truth and we his family do! The judge or a jury had to tell him he was guilty. HE TOLD THEM HE WAS GUILTY. But if he was downloading that much porn and not intending for it to be kiddie porn. WELL GUESS WHAT the boy has issues!!!! I allow my kids to download music of LimeWire. NEVER has there been any porn to pop up. And if the story that the advertiser printed was wrong. Call them and I'm sure they will invesgate it and if they are wrong they will correct it.

I think anyone arrested for this type of crime should have an articale printed in the paper about the alledged crime. So if anyone elses child are other wise has information might come forward are anyone connected can talk to their children and make sure they have not been exsposed to are directly affected by theses people. My grandchilren use limewire to down load music, I was told it was not good that it can let viruses in. But we have not exsperianced anything like anyone here is talking about. Something sounds funny here. NO I would not plead guilty either for anything if I infact was not in this case. I rather admit to murder that being deamed a petifile for the rest of my life. And to his girl friend, I hope you research him alittle more, and realize if you have children by him they can never be around him, and that is a bad life for a child to have to grow up knowing their father has plead guilty of doing this. Just sounds like to much evidence against him and like they say " love is blind ". I know of other people being arrested locally for these type of crimes and nothing is ever said in the paper. My opinion , it all should be OUT IN THE OPEN. If this person is guilty It is hard to believe he has never acted on this sickness. It really bothers me to here these family members always taking up for there children, spouse, etc. when they are convicted are plead guilty of horrible crimes, its always not them, they could never do such a thing. But you got to think, everyone has a family, and everyone is not innocent. They look stupid like the Anthony's in Florida do taking up for their crazy daughter. And she has not plead are been found guilty, it is just the evidence is there! And who cares about spelling etc. this is not about that. This is someone trying to distact away from the issue.

There's no way I would be able to stay with someone if they have done the same thing as this guy. If I had kids with him I would constantly worry about if he was doing anything with them behind my back. How these people do these horrible things is just beyond me. I feel sorry for the family and the girlfriend for having to go through this because of what he has done. He should have thought about what this would do to his family when he started downloading these videos, this kind of thing happens all the time and he shouldn't have thought that he wouldn't get caught. It's a sad, sick situation.

For all of those arguing this point, maybe you should look at the press release for the Justice Department. I don't think I would take a 30 year deal for something I didn't do.

I have only read a few of these posts and the ones that get me most are the ones that are in defense of him. Taking the blame for someone else, most honest person they know, and didn't have a choice. They lied to him telling him if he pled guilty he would go home. Apparently not one of these people seem to understand the legal system, I have taken a legal procedure class and you must describe your crime to the judge in full to enter a guilty plea. That is not a plea agreement. The charges we not lessened any from the looks of things. The gave him a choice they told him he had a right to an attorney and he didn't have to speak to them. The thing is when you have the best team looking into your private files they can tell if it was an attachment to something else they downloaded or if it was downloaded directly and where it was downloaded from, you can't deny it. He had a choice he could have took a trial, but chances are at a trial he would have been torn apart, he would have had his whole family life exposed, and he would have been outcasted by society as a whole. He still had a chance to prove his innocence. If he was honest he would have wanted to prove his honesty. I think the girl claiming to be his girlfriend only sees what she wants to...who would want to admit to themselves that their boyfriend got off on something so sick and perverted. Also a parent would protect their kid from being called a sicko, but what parent wouldn't. They would stand beside them, instead of saying that he was protecting someone else, they should be prodding their son to tell who it was that did it if that was the so called case. No matter how you want to coat it, he was guilty, they do not charge and will not put someone in jail if they knew that the person had no knowledge and by investigating the computer they would have known if it was. I also know someone who knows this guy personally and he says the guy is very tech savvy, in fact he recommended that he could probably fix our computer, so if he was tech savvy he could easily encrypt the files himself.
