Court case appealed to Atlanta court

Two former sheriff’s deputies have appealed their federal court case involving Sheriff Kevin Davis to the 11th Circuit Court of Appeals in Atlanta.
The case involves Shane Fulmer and Robby Autery and their termination of employment by Sheriff Kevin Davis. Earlier in August, a federal court judge in Montgomery dismissed the case. Another court case is currently pending in state circuit court.
Gene Rutledge, attorney for the plaintiffs, said the case revolves around two issues. One is the fact that a state legislative act was passed that established a merit board for the Sheriff’s Department, but all the members for the board have not appointed. One was supposed to be appointed by the Sheriff. The other issue revolves around the officers’ freedom of speech.
Briefs will be filed in the case this month, and oral arguments in the case will be heard later this year.
A decision in the case isn’t likely until sometime next year.

These guys deserve to at least be heard.Wrong is Wrong and I think they were done WRONG just because they were related to the former Sheriff "Press the fight" guys people who know the truth are behind you. I can't wait till 2010!

I like Kevin as a person but the Sheriff's department is in a lot of turmoil since he took over (over-budget, cutting hours, messed up cars).

i think we really messed up electing this guy to office. i hope he doesnt get re elected. i dont think they should be able to fire a deputy just because he doesnt like the guy. i hope they win their case

All Sheriff have the right to pick there deputies, remember Hardy Cook and Terry Wilson , turn around is fair play Keep doing a good job Mr. Davis

A Sheriff can hire and fire who he wants to. But when these two men were doing the job they were hired to do it just seems foolish to get rid of them because of who they were related to.And yes I remember both MR, Cook and Mr. Wilson I also remember the former Sheriff kept the current Sheriff employed. Your right turn about is fair play and I hope in 2010 we have FAIR back with Sheriff Fulmer.

Who could forget Hardy Cook? Impounding cars from Mexicans and trying to sell them back to them while you're trying to get elected to office has a way of sticking with you.

Seems to me that these guys are complaining about the same process that got them their jobs in the first place. We probably do need a merit system in place, but it is a double edged sword. A new sheriff would be stuck with deputys that might be against him, then again, it wouldn't be as easy for him to hire a bunch of good 'ol boys and cronies as his deputys. It might be harder to get rid of bad apples, though, with a merit system in place. On the other hand, with a merit system hopefully there would be some sort of minimum standard that applicants would have to meet, other than just being a cronie of the new sheriff. So, I don't know, as I said, it's a double edged sword.

Hardy Cook is dead.He cannot defend himself anymore.I think that the people Kevin fired really got what they deserve and if I can give my opinon there are a few more that he needs to get rid of.

all im saying the man everyone is putting down has made alot of bust.the sad truth is he cant be bought off and i guess that make the people who have been getting away with things mad...o well so sad for you.the point of the of department is to save lives,and keep crime out....not to bended over for a few and screw everyone else its called justice and maybe we will start seeing some....this town needs progess for all not the selected few....he was after all voted in....try working with him instead of against him...

I have never agreed with when a new sheriff goes in they have the control to hire and fire who they wish. As long as I can remember they have done this, I'm not sure but do mayor's have the same power? If so that isn't right either.
I do not know the circumstances involved, but I believe that you should give everyone a fair shot and then if they don't do their job dismiss them.
As for the Hardy Cook comment, yes cannot defend himself so out of respect I think that should be left alone. He did do some good things in this county and I'm sure made his share of mistakes, I don't know all of the details myself but whomever is without sin let him cast the first stone, guess it's already been casted huh?. There are ones that are still in office or in the line of duty and have done bad things, of course most people won't remember the good that you do only the bad things.
Just my 2 cents.
